Yes, strictly speaking there is no cheating going on - at least since the
ruling that forbade CC disks from carrying the Compact Disk logo. But they
look like regular CDs and most people aren't in the habit of checking
little details like that because there hasn't previously been anything
that looked like a CD but wasn't. Once each person gets burned once
they'll know better, but that's hardly an honest marketing behavior. It's
only slightly more honest than calling them audio CDs, which is what they
were doing at first.

On the other hand, "honest marketing" is an oxymoron.
